family educational rights and privacy act FERPA
The Family Educational Rights and Privacy Act affords eligible students currently
in attendance certain rights with respect to their education records. They are:
The right to inspect and review the student's education records. Students
should submit to Student Academic Services written requests that identify the record(s)
they wish to inspect. Student Academic Services will make arrangements for access
and notify the student of the time and place where the records may be inspected.
The right to request the amendment of the student's education records that
the student believes are inaccurate or misleading. Students may ask Johnson &
Wales University to amend a record that they believe is inaccurate or misleading.
They should write to Student Academic Services, clearly identify the part of the
record they want changed, and specify why it is inaccurate or misleading. If the
University decides not to amend the record as requested by the student, the University
will notify the student of the decision and advise the student of his or her right
to a hearing regarding the request for amendment. Additional information regarding
the hearing procedures will be provided to the student when notified of the right
to a hearing.
The right to consent to disclosures of personally identifiable information
contained in the student's education records, except to the extent that FERPA authorizes
disclosure without consent. One exception that permits disclosure without consent
is disclosure to school officials with legitimate educational interests. A school
official is a person employed by the University in an administrative, supervisory,
academic or research, or support staff position; a person or company with whom the
University has contracted; a person serving on the Board of Trustees; or a student
serving on an official committee, or assisting another school official in performing
his or her tasks. A school official has a legitimate educational interest if the
official needs to review an education record in order to fulfill his or her professional
responsibility.
The right to file a complaint with the U.S. Department of Education concerning
alleged failures by the University to comply with the requirements of FERPA. The
name and address of the office that administers FERPA is: Family Policy Compliance
Office, U.S. Department of Education, 400 Maryland Avenue, S.W., Washington, DC
20202-4605.
directory information public notice At the discretion of the University
and in conformity with FERPA, Johnson & Wales University has determined the
following to be "directory information": Student name, address, telephone
listing, email address, date and place of birth, photograph, dates of attendance,
class schedules, participation in officially recognized activities and sports, fields
of study, degrees and awards received, and the most recent previous educational
institution attended.
This information may be released by the University upon inquiry unless a student
specifically requests in writing to the contrary. To withhold disclosure of any
category of directory information under the Family Educational Rights and Privacy
Act, the Student Academic Services office must receive a written request for non-disclosure
within two weeks after the first day of each term. Requests for non-disclosure will
be honored by the University until the student either (1) submits written notice
to the Student Academic Services office terminating the original request for non-disclosure,
or (2) graduates, withdraws or otherwise changes enrollment status. Thereafter,
requests for non-disclosure may be renewed by submitting a new written request in
accordance with this paragraph.
Student Authorization To Release Information In compliance with FERPA and federal privacy laws, Johnson & Wales will release information directly to the student only, which requires the presentation of an ID or signature. A student's information may only be released to a third party upon a student's written consent.
While the University emphasizes communication within the family, students may elect to permit the release of their information to their parents or guardians. Student Authorization To Release Information forms are available in Student Academic Services for students to complete and sign. These forms allow the University to provide information to the designated parent or guardian at specific contact information.
